Terms of Use (Effective immediately upon use)
By accessing or using Atopos ("Service"), you agree to these Terms.
1. No Records, No Recovery
The Service is designed so we do not store message content, room content, room keys, one-time secrets, or session recoveries. If you lose access credentials (including a room key or secret), content is permanently unrecoverable.
2. User Responsibility
You are solely responsible for your use of the Service and any consequences that result.
3. No Warranties
The Service is provided "as is" and "as available", without warranties of any kind (express or implied), including availability, fitness for purpose, or non-infringement.
4. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of data, loss of access, misuse, misunderstanding, third-party actions, or inability to use the Service. Where liability cannot be excluded, it is limited to the amount you paid to us for tokens in the 30 days preceding the event giving rise to the claim.
5. No Duty to Act
We have no obligation to investigate, intervene, recover, reverse, or assist with communications, rooms, secrets, or outcomes.
6. Changes
We may update these Terms at any time. Continued use constitutes acceptance.
7. Governing Law
These Terms apply globally. Disputes are governed by the laws of the operator's principal place of business, without regard to conflict-of-law principles.
Acceptable Use
You agree not to use the Service for unlawful purposes, fraud, harassment, abuse, or violation of applicable laws.
We reserve the right to suspend or restrict access to the Service if we reasonably believe these Terms are violated.
Refunds
Tokens are prepaid digital access rights. Token purchases are non-refundable once delivered, except where required by law.
Subscriptions may be cancelled at any time. Cancellation stops future billing but does not retroactively refund prior charges unless required by law.
Token Purchase Terms
A. Tokens are a prepaid right to use Service features and are not a bank account, stored value facility, or deposit.
B. Tokens are non-refundable once delivered, except where required by law.
C. If a payment succeeds but tokens are not delivered, we may require a transaction identifier to investigate (e.g., Stripe payment/charge ID).
D. We do not store personal identity details by default. If you want a response from support, you must voluntarily provide contact information.
Support Limitations
A. Support is intentionally limited because the Service does not track users, rooms, or sessions.
B. We generally can only assist with billing/token issues that can be verified via a transaction identifier.
C. Do not submit sensitive content via support messages.
Translations
Translations are provided for convenience. If there is any discrepancy, the English version controls.
